OVERVIEW

Welcome to SMOKE. The terms “we”, “us”, and “our” refer to SMOKE. By accessing our website or purchasing our products, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.

1. Eligibility

You must be at least 18 years old to use our Services. All purchases are for personal use only and not for resale.

2. Products

We strive to display product information as accurately as possible. However, colors, textures, and appearance may vary depending on your device. Product availability, specifications, and pricing may change without prior notice.

3. Orders & Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for reasons including suspected fraud, unauthorized resale, pricing errors, or product unavailability. An order is accepted once payment is successfully processed and an order confirmation email is issued.

  • Pricing / 価格: Prices for the Japan market are displayed in Japanese Yen (JPY) and include consumption tax where applicable. 日本市場向けの価格は日本円（税込）で表示されます。

  • Domestic Shipping / 国内配送: As a general rule, shipping within Japan is free of charge. 日本国内への配送は原則として無料です。

  • Returns & Exchanges / 返品・交換: Returns and exchanges for domestic orders are governed by the "Domestic Orders" section of our Returns & Refund Policy. Please note that the customer is responsible for all round-trip shipping costs for exchanges due to personal preference. 国内注文の返品・交換は、返品ポリシーの「日本国内からのご注文について」の項に従います。お客様都合による交換の場合、往復の送料はお客様負担となりますのでご了承ください。

  • Act on Specified Commercial Transactions / 特定商取引法に基づく表記: Please refer to our dedicated "Legal Notice" page (Tokutei商取引法) or contact us via the form below for detailed merchant information. 特定商取引法に基づく表記の詳細については、専用ページをご確認いただくか、以下のフォームよりお問い合わせください。

4. International Pricing, Shipping & Delivery

  • Shipping Origin: All orders are shipped from Kyoto, Japan.

  • Import Terms (DDP vs. DAP):

    • DDP (USA, EU): Import duties and taxes are included in the purchase price.

    • DAP (Hong Kong, Taiwan, Korea, Oceania, Singapore and others): 
      Duties and taxes are the responsibility of the customer.
      Note for Hong Kong residents: As a free trade port, 
      Hong Kong typically does not impose customs duties 
      on our products.

  • Delivery: Delivery times are estimates and not guaranteed due to possible customs delays.

5. Returns & Refunds

Returns are handled in accordance with our Returns & Refund Policy. For international returns due to customer preference, return shipping, non-recoverable duties, and processing fees may be deducted from your refund.

6. Intellectual Property

All content on this site, including trademarks, logos, images, and product concepts, is the property of SMOKE. kitt-branded products are sold under authorized agreements. Unauthorized resale or reproduction is strictly prohibited.

7. Prohibited Uses

Unauthorized resale, fraud, intellectual property infringement, or any unlawful conduct is prohibited.

8. Disclaimer & Limitation of Liability

All products are provided “as is” without express warranties except where required by law. SMOKE shall not be liable for indirect, incidental, or consequential damages arising from the use of our products.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of Japan. Any disputes shall be submitted to the courts of Kyoto, Japan, except where mandatory consumer protection laws in your country of residence provide otherwise.
